Passengers' participation in water sports in open waters such as snorkeling, swimming and/or kayaking are done at absolute discretion of travelers who assume all inherent risks involved in the activity. Passengers are aware that these activities require optimal physical condition.
Besides following Galapagos National Park's rules and regulations for visitors, travelers have personal responsibility to YACHT LETTY, the Yacht's crew members, the Guide and to other fellow-travelers and during their cruise on YACHT LETTY, they must comply will all given instructions given by the Guide and/or Captain including security measures, personal behavior on board, accountable use of Yacht's facilities and general recommendations.

YACHT LETTY allows children to travel always in the company of an adult. However, YACHT LETTY refuses all and every liability for any accident that may occur to minors as children are the sole responsibility of their accompanying adult during the cruise and its included activities.

Passengers will be charged for any damage, loss, or theft of yacht's property caused by them. Smoking, eating, or drinking inside cabins is forbidden. Any verified violation will result in a penalty fee that must be paid by credit card (plus fee) before disembarkation, based on crew's previous evaluation of the situation; partial or full snorkeling equipment & Wet-suits damage/loss charge is $120 per event or unit damaged.

On infrequent occasions, YACHT LETTY deems necessary to cancel a pre-scheduled cruise departure and sometimes, unable to offer a suitable substitute option to travelers. In such events, we reserve the right to cancel the cruise and offer the affected passengers the following compensating alternatives:

Refund of the full net amount paid to YACHT LETTY for the canceled cruise excluding commission or marks-up added to the paid net rate. Also includes reimbursement of unused services such as domestic flight tickets to/from the Galapagos Islands and other services confirmed with YACHT LETTY.

Opportunity to travel on another date on board our YACHT LETTY as per availability of our boat (excluding Christmas or New Year's departure) with the possibility to offer passengers a cabin upgrade or even a longer cruise than they had initially booked for their trip (always subject to availability).

YACHT LETTY reserves the right to substitute yacht to similar category or better category yacht and/or other travel service due to mechanical failure, force majeure or lack of participants booked on a specific departure in addition to other reasons including, but not limited to, regulations of the Galapagos National Park.

YACHT LETTY may deem necessary to modify or change any of our YACHT LETTY'S pre-scheduled itinerary due to changes on Galapagos National Park's visiting permits to certain sites, mechanical failure or breakdown, extreme weather conditions, civil disturbance, and other reasons in which YACHT LETTY is not obligated to inform in advance to the Agency and/or Passenger as some events may occur from the beginning of the cruise or during the scheduled itinerary; passengers will only be informed of such events once on board with proper explanation and knowledge of any ongoing situation that forbids to comply with regular cruise itinerary.

Important to mention that passengers cannot pre-request or once on board the Yacht for changes on itineraries or modifications on visits to pre-determined sites in the Yacht's Patent, this includes when a departure is chartered. Variation on itineraries are exclusive decision of YACHT LETTY and considering previous possible scenarios.
